1. How do these regulation changes affect my current participant?

The regulations do not really affect current participants.  However, if you and your participant would like to extend the length of the current program, you will have to fill out a new form, the DS-7002, listing a training plan for the extended time. The extended training must be above and beyond what was in the original training plan and prove the need for the extended time.
 
2. I have a participant coming later this year but filled out the paperwork prior to June 19, 2007. How do these regulation changes affect me?

If the participant already has their DS-2019 form, then the new regulations will not affect them at all other than as shown above.  If they have not been issued their DS-2019 form yet, then the host employer needs to contact the AIPT Train USA department to find out how they will be affected.
 
3. I have been on a J-1 visa as a trainee or intern before. Under the new regulations, can I come to United States on a J-1 visa as a trainee or intern again?

1. Past participants may be allowed to return as a J-1 visa trainee or intern:

if the new program plan shows how this program will enable the development of more advanced skills or skills in a different field of expertise.

2. Participants wishing to return on the intern visa must maintain student status or begin a new internship program within 12 months of graduation.
3. Past participants of an intern program who are no longer eligible for the internship visa may participate in a training program after two years of residency outside the United States following their internship program.
4. Past participants of a trainee program may return after at least two years of residency outside the United States following their initial program.
5. There is no limit on the number of times an individual can participate, as long as they are eligible.
